Murder, Rape Cases in Pre-Trial Proceedings

Various murder and rape cases came before Judge Christi Liebenberg in the Windhoek High Court for pre-trial proceedings.

A pre-trial proceeding involves deciding who will preside over the trial and who will be the prosecutor.

It is also where disputes and agreements are sorted out such as what evidence will be admitted and what will be disputed during the trial, to save time.

The following pre-trial conferences were held on Thursday last week before Judge Liebenberg:

Edmund Jagger is accused of murdering his girlfriend and mother of his child.

It is alleged that Jagger killed 22-year-old Renelda Alien Oamite Hoeses by stabbing her 18 times.

According to the indictment, Jagger entered the residence of the deceased’s father at Erf 1978, Build Together in Orwetoweni in Otjiwarongo during the late night hours of Friday March 01, 2013 or the early morning hours of March 02, 2013 armed with a knife and attacked her.

After the attack, it is stated Jagger fled the scene and attempted to commit suicide.

He still did not have a legal representative, but the judge ordered that he should not be returned to the holding cells until he has completed a fresh legal aid application as he told the judge that legal aid could not find his original application.

In the meanwhile legal aid lawyer Bronell Uirab was asked by the judge to take up the matter.

Charles Noabeb, 27, the man accused of raping and killing Cintha Roberta Gaeses at Collin Foundation School in Arandis also made a first pre-trial appearance on Thursday.

Noabeb is being defended by Milton Engelbrecht of the Boris Isaacks law firm on instructions of legal aid and Deputy Prosecutor General Antonia Verhoef will prosecute.

According to the indictment, Noabeb faces one count of murder, one count of rape alternatively crimen injuria, one count of robbery with aggravating circumstances and one count of defeating or obstructing or attempting to defeat or obstruct the course of justice.

It is alleged that he followed and overpowered Gaeses who was on her way home after a night out with friends in Arandis.

According to the indictment, Noabeb stabbed the deceased at least 29 times all over her body.

He then proceeded to remove her clothing and raped her.

After the alleged rape Noabeb robbed her of her cellphone and SIM card whereafter he dumped her body in a corner at Collin Foundation Secondary School and covered her body with trash from a nearby trash can, the indictment reads.

It is further alleged in an effort to conceal the crime he hid the deceased’s clothes on top of the roof of the school and burnt, destroyed or otherwise disposed of the cellphone and SIM card of the deceased as well as covered the deceased’s blood and the used condoms on the crime scene with sand.

Both matters were postponed to January 22 next year for another pre-trial conference.
