Three Accused Men Deny Gang Rape

THREE men accused of having gang-raped a woman at Khorixas five years ago denied guilt on a multitude of charges in the Windhoek High Court yesterday.

Each of the three accused – Victum Gomeb, Elvis Gao-Goab, and Harry Patrick Bowe – is charged with three counts of rape in connection with the incident that allegedly took place near a church at Khorixas on 13 May 2010.

With the three men denying guilt on all charges at the start of their trial before Judge Alfred Siboleka yesterday, defence lawyer Monty Karuaihe, who is representing Gomeb, told the judge his client would remain silent at this stage and his defence would become apparent during the trial.

Gao-Goab’s defence lawyer, Milton Engelbrecht, told the judge his client was denying all allegations that he had raped the complainant in the matter. According to Gao-Goab he had intercourse with the complainant with her consent, and he stopped the encounter when she asked him to do so, Engelbrecht said.

Bowe’s lawyer, Johan van Vuuren, said according to his client he and his co-accused had been in the complainant’s company at a bar at Khorixas, where they were consuming alcohol, on the day of the alleged incident. Bowe and Gao-Goab later found the complainant and Gomeb having intercourse, Van Vuuren said. He added that Bowe and Gomeb left that scene together.

In the indictment setting out the prosecution’s charges against the three men, it is alleged that the complainant and the three accused had been drinking at a bar at Khorixas on 13 May 2010.

They later left the bar together. The prosecution is alleging that Gomeb then grabbed the complainant and pulled her towards a church at the town. He allegedly also pushed her to the ground, and his two co-accused then helped him to undress the complainant before he raped her, the state is charging.

Bowe was the second one of the accused to rape the woman, while the other two accused men held her down, the prosecution is alleging.

Bowe and Gomeb left Gao-Goab behind when they left the scene, and Gao-Goab then also raped the complainant, it is alleged in the indictment.
