An American national who is on trial in the High Court for the alleged killing of Windhoek resident Andre Heckmair during January 2011, is still seeking to have High Court Judge Christie Liebenberg recused from his murder trial.

This is the third time Marcus Kevin Tomas is seeking the removal of the judge from his murder trial.

Today, Tomas' third application for the recusal was set to be heard before the same judge, but the application could not proceed as scheduled because Tomas did not file his heads of argument before the Registrar of the High Court.

This is because he was still awaiting a response from the Justice Ministry's Directorate of Legal Aid for State-funded legal representation.

In the result, High Court Judge Liebenberg today issued an order directing the removal of Tomas' application from the roll of the High Court.

Tomas was, thereafter, also ordered to file his application before the Registrar of the High Court afresh once he finally sorts out his pending legal representation issues with the Directorate of Legal Aid.
