Oil and Gas Boom Places Pressure on Namibia’s Legal Sector: Kauta

Windhoek: The recent discoveries of oil and gas are presenting one of the most defining challenges for Namibia's legal sector, Cliffe Dekker Hofmeyr (CDH) Managing Partner and Director in Namibia, Patrick Kauta, has said. Kauta made the remarks during the launch of the Legal 500 General Counsel (GC) Powerlist: Namibia 2026 in Windhoek, which aims to recognise the vital role played by general counsel.

According to Namibia Press Agency, Kauta emphasized that the rapid acceleration of oil and gas discoveries brings with it complex challenges. These developments attract global capital, multinational counterparties, and increased regulatory, environmental, and political scrutiny. As a result, general counsel are increasingly tasked with navigating licensing requirements, local content obligations, joint ventures, and cross-border risks, while ensuring governance frameworks can withstand long project life cycles, price volatility, and evolving regulatory expectations.

Kauta also discussed the growing responsibility of environmental, social, and governance stewardship linked to oil and gas development. This places general counsel at the forefront of balancing economic opportunities with environmental protection and community engagement. He underscored the critical role of legal frameworks, contractual arrangements, and governance mechanisms in protecting both commercial interests and Namibia's broader social and environmental commitments.

Additionally, he highlighted the importance of Namibia's constitutional framework and the judiciary's role in maintaining stability. Kauta praised the constitution's interpretation, implementation, and execution through judgments, which have contributed to Namibia's economic stability and reputation as a country of good governance and investment.

Josephine Shigwedha, Executive for Regulatory and Corporate Legal Services at the Communications Regulatory Authority of Namibia (CRAN), also spoke at the event, emphasizing the need for modern general counsel to understand the industries in which their organizations operate.
