Windhoek: Speaker of the National Assembly, Saara Kuugongelwa-Amadhila, on Wednesday released President Netumbo Nandi-Ndaitwah's signed nomination letter for the appointment of the Electoral Commission of Namibia (ECN) chairperson and two commissioners to lawmakers.According to Namibia Press Agency, the ruling followed opposition threats to approach the courts to compel the disclosure of documents related to the nomination of Gerson Sindano as ECN chairperson and two other commissioners. Tuesday's National Assembly (NA) sitting ended in a deadlock after opposition lawmakers boycotted proceedings to affirm the nominations, insisting that documents relating to the recruitment and interview process be made available before Parliament could consider the appointments.President Nandi-Ndaitwah nominated Sindano, currently an ECN commissioner, to serve as chairperson for the remaining nine months of his term. She also nominated Emmerentia Leonard and Julieta Diva Ferreira as commissioners.Delivering her ruling at the start of Wednesday's sitting, Kuugongelwa-Amadhila said the Electoral Act clearly defines the roles of the selection committee, the President, and the National Assembly in the appointment process. She explained that once the selection committee, established under Section 5 of the Electoral Act, had received applications, interviewed candidates, and submitted its recommendations to the President, it had fulfilled its statutory mandate.'The mandate of this House is confined to determining whether to approve or reject the President's nominations. It is not the function of the National Assembly to scrutinise, review, or revisit the internal processes, deliberations, or evaluation records of the committee,' she said.Kuugongelwa-Amadhila noted that the documents properly before Parliament were the President's nominations submitted in terms of Section 6(17) of the Electoral Act, together with any other documents lawfully forming part of the NA's proceedings. She added that scoring sheets, interview assess ments, evaluation records, and other deliberative documents remained the property of the selection committee and could not be released by the Speaker.Following the ruling, Affirmative Repositioning leader Job Amupanda welcomed the release of the President's signed nomination letter but said the opposition party was still studying its contents. 'Our lawyers received this letter from Government Attorneys regarding our demand for transparency. While this is welcomed, we are still discussing the content because other records are still hidden,' Amupanda said.Landless People's Movement lawmaker Eneas Emvula supported opposition calls for the release of the selection committee's records, saying Parliament had a constitutional duty to scrutinise executive appointments. 'The objections raised by fellow members in respect of the ECN appointment are legal questions that deserve proper consideration. The concern is that the process does not comply with the Constitution and the Electoral Act,' said Emvula.
